DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, any conditions or warranties imposed or implied by law are hereby expressly excluded. Consumers may nevertheless have the benefit of certain rights or remedies pursuant to the Trade Practices Act 1974 (Cth) and similar legislation in States or Territories in Australia, in respect of which liability may not be excluded. Insofar as such liability may not be excluded, then to the maximum extent permitted by law, such liability is limited, at the exclusive option of Paterson’s Cake Shop to either: (a) a replacement order of a similar as possible product to that ordered; or (b) the return of the price you paid for the order.

To the maximum extent permitted by applicable law, in no event will Paterson’s Cake Shop or associated parties or its suppliers be liable to you for any indirect, incidental, consequential or special damages, including without limitation any lost profits, lost savings, loss of goodwill, work stoppage or other interruption, loss of business information, computer failure or malfunction or any and all other damages or losses arising out of the use or inability to use the Paterson’s Cake Shop website or connection or non connection to a website operated by Paterson’s Cake Shop or associated parties or its suppliers or any of the above damages in relation to any order placed on this website even if advised of the possibility of such damages.  Paterson’s Cake Shop or associated parties or its suppliers will also not be liable for any damage to your computer that arises out of the use of this website.

Should there be any complaint about an order after delivery, no claims will be recognized without return of goods, unless it is proved that a delivery did not occur due to the fault of Paterson’s Cake Shop.

APPLICABLE LAW

The laws of the State of Victoria apply to this website and any agreement between us and you. It is expressly agreed that a Victorian Court has exclusive jurisdiction over any dispute.

SEVERABILITY

If any of these Conditions of Use shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
